LABOUR WELFARE FUND – TAMIL NADU ACT – AN ALTERNATIVE
The Tamil Nadu Labour Welfare Fund Act provides for the constitution of a fund for promoting the welfare of labour. It envisages constitution of a fund for promoting the welfare of labour in every establishment covered under the Act.
Section 3 requires the Government to constitute a fund called the Labour Welfare Fund.
Section 4 empowers the State Government to establish a Board by name “Tamil Nadu Labour Welfare Fund”.
There are provisions for making contribution to the fund both by the employers and employees, besides receiving such amounts as are specified in other provisions of the Act like unpaid accumulations, fines, etc.
No information is available in the public domain that ever since the Act was passed in 1972, whether any establishment constituted a separate Labour Welfare Fund for itself and sought exemption from the provisions of the Act.
